Terms of Service

These Terms of Service govern your access to and use of Nocturne Engine, including our hosted Web Workspace and Discord bot integrations.

Summary: Nocturne Engine is an open-source community software project provided free of charge for experimental and developer use. By using our hosted services, you agree to respect rate limits, abide by our 16+ age requirement, and acknowledge all risks.

01. Acceptance & Community Nature

By accessing, browsing, or using the hosted services of Nocturne Engine ("the Service"), connecting our Discord bot, or creating a session in the Web Workspace, you agree to be bound by these Terms of Service.

Nocturne Engine is an open-source community project maintained by voluntary developers without a corporate or commercial legal entity. If you do not agree to these Terms in full, you must discontinue your use of our hosted services immediately.

02. Age Eligibility (16+)

To use Nocturne Engine's hosted Web Workspace or Discord integrations, you must be at least 16 years of age (in compliance with European GDPR digital consent standards). If you are under 16, you are not authorized to use the hosted platform.

03. Description of Service

Nocturne Engine provides a modular Node.js engine for multi-platform LLM bots and agentic tools:

  • Web Workspace: A browser-based chat environment featuring real-time Server-Sent Events (SSE) streaming, multimodal image analysis, and conversation management.
  • Discord Bot: Discord slash command integration (/chat, /model, /reset, /ping) for channels, direct messages, and guild threads.
  • Agentic Tool Calling: Automated tool dispatching for live web search and isolated script evaluations.

04. Acceptable Use & Conduct

You agree to use Nocturne Engine responsibly and agree strictly not to:

  • Submit prompts or code intended to generate illegal, defamatory, abusive, or harmful material.
  • Deploy automated scripts, bots, or scrapers to overwhelm our REST or SSE endpoints beyond designated rate limits.
  • Distribute malicious software, ransomware, or exploits via chat inputs or image uploads.
  • Violate Discord Terms of Service or Community Guidelines when interacting with the Discord bot.

05. Intellectual Property & Output Ownership

We respect developer and creator ownership over content:

  • Your Inputs: You retain all intellectual property rights and full ownership of all prompts, text, code, queries, and media you submit to Nocturne Engine.
  • Your Outputs: To the maximum extent permitted by applicable law, you own all rights, title, and interest in and to the outputs (including code snippets, calculations, and text) generated for you by the model. You are free to use, modify, and distribute these outputs for personal, educational, or commercial projects.
  • Model Output Disclaimers: Generative models produce probabilistic, non-deterministic output. Responses may contain logic errors or inaccurate facts. You are solely responsible for reviewing and verifying any code or calculations before executing them in production environments.
  • No Training Use: Because our hosted instance utilizes private local model backends, your inputs and generated outputs are never fed back into foundational AI training pools.

06. Service Availability & Non-SLA Disclaimer

The official hosted deployment of Nocturne Engine is provided free of charge by voluntary open-source maintainers on private compute resources:

  • No Service Level Agreement (Zero SLA): We provide no guarantees of continuous, uninterrupted, or error-free service availability.
  • Throttling & Queuing: We reserve the right to throttle concurrent connections, enforce dynamic rate limits, implement queue delays, or take the service offline for maintenance or model updates without advance notice.

07. Open Source ISC Licensing & Self-Hosting

The Nocturne Engine source code is licensed under the ISC License. You are encouraged to inspect, fork, modify, and self-host the repository in accordance with open-source license provisions.

If you host an independent deployment of Nocturne Engine:

  • You act as an entirely independent data controller and service operator.
  • You assume sole responsibility for your instance's security, API infrastructure, costs, privacy policies, and user compliance.
  • You may not state or imply endorsement by the original Nocturne Engine maintainers.

08. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE MAINTAINERS OR COMMUNITY CONTRIBUTORS OF NOCTURNE ENGINE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

09. Modifications, Termination & Contact

We reserve the right to modify these Terms at any time. Continued use of the platform following the posting of revised Terms constitutes acceptance.
